Only Representative (OR)

REACH Regulation specifies that all the responsabilities for REACH rest with the person within the EU responsible for placing the chemical substance on the market.

As REACH Regulation applies across all Europe, non-EU companies cannot fulfil the requirements of REACH by themselves and they are obliged to designate (as per Article 8) an “Only Representative” who will be responsible for fulfilling the registration and hazard communication duties that would otherwise fall upon the importers of specific substances into Europe.

As stated in Article 8 a “natural or legal person” in the EU may take on the role as nominated Only Representative (OR). This legal requirement is intended to identify the person who can be prosecuted in Europe if things go wrong. Also, is stated that such a person must have sufficient background in the handling of substances and information related to them.

Designating an OR will help non-EU manufacturers to protect their confidential business information (CBI) that would need to be shared with the importers if registration duties were left to them.
